Terms of Service

Privacy Policy Terms of Service Student Enrollment Agreement

Effective date: October 24, 2026

These Terms of Service ("Terms") are a binding agreement between you and Language Climber LLC, doing business as Language Climber ("Language Climber," "we," "us," "our"). They govern your use of languageclimber.com (the "Site") and our live online lessons, workplace language training, and Citizenship and GED preparation (the "Services"). If you enroll in a course, our Student Enrollment Agreement also applies and controls on payment, renewal, cancellation, and refunds. Our Privacy Policy explains how we handle personal information.

PLEASE READ SECTION 13 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT WITHIN 30 DAYS.

By using the Site, enrolling, or attending a class, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility

You must be at least 18 to enroll or pay for Services. Students ages 13 to 17 may take classes only if a parent or legal guardian enrolls them and agrees to these Terms for them. The parent or guardian is responsible for the student's compliance and for all charges. We do not accept students under 13.

2. The Services

We provide live, instructor-led language lessons delivered by video, together with placement assessments, course materials, and progress tracking. Class times, levels, instructors, curriculum, and the video platform we use may change. We will give enrolled students reasonable notice of material changes.

You are responsible for a working internet connection, a device with a camera and microphone, and any software the video platform requires.

3. No guarantee of results

Language learning depends on each student's attendance, practice, and effort. We do not guarantee any particular level of fluency, score, job outcome, or that you will pass any examination, including the U.S. naturalization (citizenship) interview and civics and English tests, the GED test, or any employer or certification assessment. Placement results and progress reports are our instructors' educational assessments only.

4. Citizenship and GED preparation: important disclaimers

  • Not legal or immigration advice. Our Citizenship course teaches English, U.S. history and civics, and interview practice. We are not lawyers or accredited representatives, and we do not give legal or immigration advice. We do not prepare, review, complete, translate, or file any immigration form (including Form N-400), advise on eligibility, or communicate with any government agency on your behalf. For legal advice, consult a licensed attorney or a representative accredited by the U.S. Department of Justice.
  • No government affiliation. Language Climber is not affiliated with, endorsed by, or acting for U.S. Citizenship and Immigration Services (USCIS) or any government agency. We cannot influence the outcome of any application or interview.
  • GED. GED® is a registered trademark of the American Council on Education and is administered by GED Testing Service LLC. Language Climber is not affiliated with or endorsed by either. We do not register you for the GED test or issue any diploma or credential.
  • Not an accredited school. Language Climber is a private tutoring and training provider. We do not grant academic credit, degrees, or diplomas. Any certificate of completion we issue reflects attendance at our course only.

5. Your account and information

You agree to give us accurate, current information and to keep it updated. You are responsible for activity under your account and for keeping class links and login details private. Class links are for the enrolled student only and may not be shared.

6. Payment

Fees, billing, automatic renewal, pausing, cancellation, and refunds are governed by the Student Enrollment Agreement. Employer-sponsored training is governed by the written agreement between Language Climber and the employer.

7. Classroom conduct

We want every class to be a respectful, safe place to learn. You agree not to:

  • harass, threaten, insult, or discriminate against instructors or other students;
  • share sexual, violent, hateful, or otherwise inappropriate content;
  • record, photograph, screenshot, stream, or distribute any class, instructor, or student without our written permission and the consent of everyone recorded;
  • share your class link or let anyone else attend in your place;
  • contact instructors or other students outside class for non-educational purposes after being asked to stop, or solicit them for any business;
  • hire or engage a Language Climber instructor directly for private lessons, during your enrollment and for 12 months after, without our written consent;
  • disrupt a class, impersonate anyone, or misuse the Site (for example, by scraping, hacking, or introducing malware).

We may warn, remove from a class, suspend, or end the enrollment of anyone who violates this section. If we end an enrollment for a serious or repeated violation, the refund terms in the Student Enrollment Agreement apply.

8. Course materials and intellectual property

The Site, our curriculum, lesson plans, worksheets, recordings, placement assessments, and other materials ("Materials") are owned by Language Climber or its licensors and are protected by copyright and trademark law. While you are enrolled, we grant you a limited, personal, non-transferable, revocable license to use the Materials for your own learning. You may not copy, sell, share, post publicly, or create derivative works from the Materials, or use them to teach others.

Official public-domain government study materials remain public domain. "Language Climber" and our logo are our trademarks.

9. Your content and feedback

You keep ownership of homework, writing, and other work you submit. You give us a limited license to use it to teach you, give feedback, and run the Services. We will not publish your work, name, image, voice, or testimonial without your separate written consent. If you send us suggestions or feedback, we may use them without obligation to you.

10. Third-party services

The Services rely on third parties, including Stripe for payments and Zoom for video classes. Your use of those services is subject to their own terms. We are not responsible for their availability, security, or practices, though we choose providers carefully.

11. Disclaimers

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR THE STUDENT ENROLLMENT AGREEMENT, THE SITE, SERVICES, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that the Site or video platform will be uninterrupted or error-free. If a class cannot take place because of a technical problem on our side, we will reschedule it or credit you as the Student Enrollment Agreement provides.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS: (a) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, OR THE OUTCOME OF ANY EXAMINATION, INTERVIEW, OR APPLICATION; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply to liability that cannot be limited under applicable law, including for gross negligence, willful misconduct, or personal injury caused by our negligence.

13. Dispute resolution and arbitration

Informal resolution first. Before starting any claim, you and we agree to try to resolve the dispute informally. Send a written description of the dispute and the relief you want to info@languageclimber.com or our mailing address. If we cannot resolve it within 30 days, either party may proceed as below.

Binding individual arbitration. Any dispute arising out of or relating to these Terms, the Student Enrollment Agreement, the Site, or the Services will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this section. Arbitration may be conducted by video or in Suffolk County, New York, or in the county where you live if you prefer. For claims we bring or that you bring, we will pay all AAA filing, administration, and arbitrator fees beyond the amount you would pay to file in court.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek a court order to stop infringement or misuse of intellectual property.

Class action and jury waiver. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may award relief only on an individual basis. If this class waiver is found unenforceable for a claim, that claim will proceed in court, not arbitration.

30-day opt-out. You may opt out of this arbitration agreement by emailing info@languageclimber.com within 30 days after you first accept these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Time limit. To the extent the law allows, any claim must be filed within one (1) year after it arises.

14. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by the Federal Arbitration Act. Any court proceeding permitted by these Terms will be brought only in the state or federal courts located in Suffolk County, New York, and you and we consent to their jurisdiction.

15. Indemnification

You agree to indemnify and hold harmless Language Climber and its owners, employees, and instructors from third-party claims, losses, and reasonable attorneys' fees arising from your violation of these Terms or of anyone's rights, including by recording or distributing a class.

16. Suspension and termination

We may suspend or end your access to the Site or Services for violation of these Terms, non-payment, or conduct that puts instructors or students at risk. You may stop using the Services at any time, subject to the cancellation terms in the Student Enrollment Agreement. Sections 3, 4, 8, 9, and 11 through 18 survive termination.

17. Changes to these Terms

We may update these Terms. We will post the new version with a new effective date and, for material changes, email enrolled students at least 30 days before the change takes effect. Changes do not apply to a dispute that arose before the change. If you do not agree to a change, you may cancel before it takes effect.

18. General

  • Electronic communications. You agree to receive notices, receipts, and agreements electronically, and that they satisfy any legal requirement that they be in writing.
  • Entire agreement. These Terms, the Student Enrollment Agreement, and the Privacy Policy are the entire agreement between you and us about the Services.
  • Severability. If any provision is unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver.
  • Assignment. You may not transfer these Terms. We may assign them in connection with a sale or reorganization of our business.
  • Force majeure. We are not liable for delays caused by events beyond our reasonable control, including internet or platform outages, power failures, illness, or natural disasters.
  • Language. We may provide these Terms in Spanish for convenience. If there is a conflict, the English version controls.
